M A C HAMER (first defendant) and ANDIUM HOMES LIMITED (second defendant): (1) the first defendant to acknowledge her indebtedness pursuant to bond in the capital sum of £204,715 bearing interest, subscribed by her in favour of the plaintiff Lloyds Bank Corporate Markets Plc. (2) the second defendant to declare that it will not avail itself of its hypothecary rights by virtue of the registration of the Act of the Royal Court dated this day and year to the prejudice of the hypothecary rights hereby obtained by the plaintiff which said rights shall be deemed to rank prior to those obtained by the second defendant by virtue of the Andium Charge. (3) the second defendant will be party to any subsequent re-registration of this present Act of Court to preserve the ranking order agreed.
